1. Site Use

Trigada AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services strictly in accordance with these Terms. You agree to use the Site and Services only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations.

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use our Services. By using the Site, you represent and warrant that you meet this age requirement.

We reserve the right to modify, suspend, or discontinue any aspect of the Site or Services at any time, with or without notice, and without liability to you or any third party.

Trigada AI reserves the right to update, amend, or modify these Terms at any time at our sole discretion. When material changes are made, we will update the "Last Updated" date at the top of this page. We may, but are not obligated to, notify you of significant changes via email or a prominent notice on the Site.

4. No Investment Advice

Nothing on the Site or within the Services constitutes investment advice, financial advice, trading advice, or any other form of professional advice. All content, algorithmic outputs, market data, analytics, trade signals, and related materials provided through the Services are for informational and educational purposes only.

Trigada AI is not a registered investment adviser, broker-dealer, financial planner, or fiduciary. No fiduciary relationship is created between you and Trigada AI by virtue of your use of the Services. You should consult a qualified, licensed financial professional before making any investment or trading decisions.

Past performance of any algorithm, strategy, or tool provided through the Services is not indicative of future results. Any hypothetical or backtested performance data is provided for illustrative purposes only and does not represent actual trading results.

5. No Direct Lending

Trigada AI does not operate as a bank, credit institution, or lending entity. We do not offer, facilitate, broker, or arrange loans, credit facilities, or any form of direct or indirect lending to users or third parties. Any references to financial products or services on the Site are strictly informational and do not constitute an offer or solicitation to lend or borrow funds.

6. Regulatory Compliance, AML/KYC, and Sanctions

You represent and warrant that your use of the Services complies with all applicable laws and regulations in your jurisdiction, including but not limited to anti-money laundering (AML) laws, counter-terrorism financing (CTF) regulations, and know-your-customer (KYC) requirements.

Trigada AI reserves the right to conduct identity verification, request documentation, and perform due diligence checks on any user at any time. We may refuse service, restrict access, or terminate your account if we reasonably believe that your use of the Services involves proceeds of unlawful activity, violates any sanctions regime, or otherwise presents legal or reputational risk to the Company.

You agree that you are not located in, organized under the laws of, or a resident or national of any country or territory subject to comprehensive economic sanctions imposed by the United States, United Nations, or other applicable sanctioning authority, and that you are not listed on any restricted or denied persons list.

7. Trading Risk Disclosure

Trading in financial instruments — including but not limited to stocks, options, futures, FX, and digital assets — carries a high degree of risk and is not suitable for all individuals. You could sustain a total loss of the funds you allocate to trading, and in certain circumstances, you may incur losses exceeding your initial deposit.

You acknowledge and agree that:

• Algorithmic and automated trading systems involve unique risks, including technology failures, connectivity issues, and execution delays.
• Market conditions can change rapidly, and historical performance does not guarantee future outcomes.
• Leverage, if used, can amplify both gains and losses substantially.
• You are solely responsible for all trading decisions, even when using tools or signals provided by Trigada AI.
• Trigada AI bears no responsibility for any financial losses, damages, or costs arising from your trading activity.

You should only trade with funds you can afford to lose entirely. If you do not fully understand the risks involved, you should seek independent professional advice before engaging in any trading activity.

8. Intellectual Property

All content, materials, features, and functionality available on the Site and through the Services — including but not limited to text, graphics, logos, icons, images, audio, video, software, algorithms, data compilations, and the design, selection, and arrangement thereof — are the exclusive property of Trigada AI or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Trigada AI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Trigada AI. You may not use such marks without our prior written permission.

You are granted no right or license to reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, reverse engineer, decompile, or otherwise exploit any of our intellectual property, except as expressly authorized by these Terms or with our written consent.

9. User Conduct

You agree not to use the Site or Services in any manner that is unlawful, harmful, or inconsistent with these Terms. Without limitation, you agree not to:

• Violate any applicable local, national, or international law or regulation.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Interfere with, disrupt, or impose an unreasonable burden on the Site, its servers, or connected networks.
• Attempt to gain unauthorized access to any portion of the Site, other accounts, systems, or networks.
• Use any automated means (bots, scrapers, crawlers, spiders, or similar tools) to access, collect, or extract data from the Site without our express written consent.
• Transmit any viruses, malware, worms, trojan horses, or other harmful or malicious code.
• Harvest, collect, or store personal information about other users without their consent.
• Use the Services to engage in market manipulation, spoofing, layering, wash trading, or any other form of fraudulent or deceptive trading activity.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of any part of the Services.
• Resell, sublicense, redistribute, or commercially exploit the Services or any content derived therefrom without prior written authorization.
• Use the Services for any purpose that is competitive with or detrimental to Trigada AI.
• Circumvent, disable, or otherwise interfere with security-related features of the Site.

Trigada AI reserves the right to investigate and take appropriate action against any violation of these provisions, including without limitation removing content, suspending or terminating accounts, and reporting offenders to law enforcement authorities.

10. Account Registration

Certain features of the Services may require you to create an account. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate and current.

You are responsible for all activity that occurs under your account. You must safeguard your login credentials and must not share your account with any third party. Trigada AI will not be liable for any loss or damage arising from your failure to secure your account.

We reserve the right to suspend or terminate your account at any time and for any reason, including but not limited to a breach of these Terms, suspected fraudulent or illegal activity, or extended periods of inactivity, without prior notice and without liability.

11. Billing and Cancellation

Certain Services may be offered on a subscription basis or require payment of fees. By purchasing a subscription or paid Service, you agree to pay all applicable fees as described at the time of purchase.

Recurring Billing: Subscriptions automatically renew at the end of each billing cycle unless you cancel prior to the renewal date. You authorize Trigada AI (or our payment processor) to charge your designated payment method for each renewal period.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have already paid.

No Refunds: Except where required by applicable law, all fees are non-refundable. This includes, without limitation, fees for partially used billing periods and unused features or Services. Trigada AI reserves the right to modify pricing at any time, with notice provided to existing subscribers before the next renewal.

12. Payment Methods

Trigada AI accepts payment through major credit and debit cards, and such other payment methods as we may make available from time to time. All payments are processed through third-party payment processors. By submitting payment information, you represent that you are authorized to use the designated payment method and authorize us to charge all fees to that method.

You are responsible for any applicable taxes, fees, or charges imposed by your financial institution or government. If a payment fails or is declined, we may suspend access to paid Services until payment is successfully processed.

13. Social Media

Trigada AI may maintain a presence on third-party social media platforms. Content posted by Trigada AI on social media is for informational and promotional purposes only and does not constitute investment advice or an endorsement of any product, service, or strategy.

User interactions on our social media channels (comments, shares, direct messages) are subject to these Terms as well as the terms and policies of the respective social media platform. Trigada AI is not responsible for content posted by third parties on our social media pages.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRIGADA AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND COMPLETENESS.

Trigada AI does not warrant that the Site or Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee that any results, outputs, or data obtained through the Services will be accurate, reliable, or complete.

Any reliance you place on information or materials provided through the Site or Services is strictly at your own risk. Trigada AI shall have no liability or responsibility for any errors, omissions, or inaccuracies in any content.

16. Disclaimer of Liabilities

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRIGADA AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES.

This limitation applies regardless of the legal theory upon which the claim is based, whether contract, tort (including negligence), strict liability, or otherwise, and even if Trigada AI has been advised of the possibility of such damages.

In jurisdictions that do not permit the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or the Services exceed the amounts you have paid to Trigada AI during the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

17. Governing Law & Arbitration

These Terms shall be governed by and construed in accordance with the laws applicable to international commercial agreements, without regard to conflict-of-law principles.

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Services, including their formation, interpretation, breach, or termination, shall be finally resolved by binding arbitration administered in accordance with the rules of a mutually agreed-upon international arbitration body. If the parties cannot agree on an arbitration body, arbitration shall be conducted under the rules of the International Chamber of Commerce (ICC).

The arbitration shall be conducted in the English language. The arbitral award shall be final and binding upon both parties and may be enforced in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as part of a class, consolidated, or representative action. You waive the right to participate in any class action lawsuit or class-wide arbitration against Trigada AI.

Exception: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

18. Indemnification

You agree to indemnify, defend, and hold harmless Trigada AI and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and court costs) arising out of or related to:

• Your use of or access to the Site or Services.
• Your violation of these Terms or any applicable law or regulation.
• Your violation of any rights of a third party, including intellectual property, privacy, or publicity rights.
• Any content you submit, post, or transmit through the Services.
• Any trading, investment, or financial decisions you make based on information obtained through the Services.

This indemnification obligation shall survive the termination of these Terms and your use of the Services.

20. Testimonials & Submissions

Any testimonials, reviews, feedback, ideas, suggestions, or other submissions you provide to Trigada AI — whether through the Site, email, social media, or any other channel — become the property of Trigada AI. By submitting such content, you grant us a worldwide, perpetual, irrevocable, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

Testimonials displayed on the Site represent individual experiences and do not guarantee that all users will achieve similar results. Testimonials may be edited for length or clarity but will not be altered in a way that changes their meaning.

You represent and warrant that any content you submit does not infringe the rights of any third party and that you have the authority to grant the rights described above.

21. Affiliate Disclosures

Trigada AI may participate in affiliate programs and may receive compensation for referring users to third-party products, services, or platforms. Such relationships do not influence the objectivity of our content or recommendations, but you should be aware that we may earn commissions from qualifying purchases or sign-ups made through affiliate links on the Site.

22. Severability

No waiver of any provision of these Terms by Trigada AI shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
